Collective complaint
An additional protocol to the Revised European Social Charter provides for the possibility of lodging a collective complaint. A collective complaint is a legal remedy before the ESRB against a violation of the Charter. Belgium has signed this protocol.
The Belgian sector for people with disabilities has twice made use of the possibility to file a collective complaint:
- to denounce the lack of housing and care facilities for children with disabilities in serious need of care in the French Community. The ESRB has condemned Belgium for this;
De Belgische sector voor personen met een handicap heeft twee keer gebruik gemaakt van de mogelijkheid om een collectieve klacht in te dienen:
- om het gebrek aan huisvesting en opvangplaatsen voor zwaar zorgbehoevende kinderen met een handicap in de Franse Gemeenschap aan te klagen. Het ECSR heeft België hiervoor veroordeeld;

- to denounce the lack of places for children with intellectual disabilities in inclusive regular education in the Flemish Community. The ECRS is investigating the dossier.
